Terms of carriage
The key terms that apply when you ship with Timmy Freight SRL. They are a summary for business customers; a signed transport order or framework agreement takes precedence.
Applicable rules
International road transport is governed by the Convention on the Contract for the International Carriage of Goods by Road (CMR, Geneva 1956). Transport within Romania is governed by the provisions of the Romanian Civil Code on the contract of carriage.
Orders and quotes
A quote is valid for the period stated on it. A transport order becomes binding once we confirm it in writing. Please give us pickup and delivery addresses and time windows, a description of the goods, gross weight, number of pallets or loading metres, and any special requirements.
Loading and securing
Unless agreed otherwise, the sender loads the goods and makes sure they are properly packed. Our driver checks that the load is secured for road safety and may refuse to depart with an unsafe load.
Liability
Our liability for loss of or damage to goods follows the CMR and is limited to 8.33 Special Drawing Rights per kilogram of gross weight (Art. 23 CMR). Higher cover is possible if you declare a higher value (Art. 24) or a special interest in delivery (Art. 26), agreed in writing against a surcharge.
Claims
Visible loss or damage must be noted on the CMR consignment note at delivery. Damage that is not visible must be reported in writing within 7 days of delivery (Sundays and public holidays excluded), and delay within 21 days (Art. 30 CMR). Claims are time-barred after one year (Art. 32 CMR).
Insurance
Every international load travels under our CMR carrier liability insurance. We will send you a copy of the certificate on request.
Goods we do not carry
Unless agreed in writing in advance, we do not carry dangerous goods (ADR), temperature-controlled goods, live animals or high-value goods such as cash or jewellery.
